CONTRACT OF PUBLIC OFFER OF GOODS BUY AND SALE

This contract is addressed to Consumers and is the official and public offer of the Seller, represented by the self-employed person "Lev Polina Sergeevna", which acts on the basis of the State Registration Statement 3571409000 dated October 6, 2017. The consumer, acting for the purpose of acquiring the Goods, accepts the terms of this contract (further - Contract) as follows:

1. GENERAL CONDITIONS

1.1. This contract is a public offer contract (in accordance with Articles 633, 641 and Chapter 54 of the Civil Code of Ukraine), its conditions are the same for all customers regardless of status (individual, legal entity, individual entrepreneur).


1.2. In case of acceptance of the terms of this agreement, the consumer becomes the Buyer.


1.3. By concluding the Agreement, the Buyer confirms that he is fully acquainted and agrees with its terms, and, if the Buyer is a private individual, he gives permission for the Seller to process his personal data in order to be able to fulfill the conditions of this Agreement, the possibility of mutual settlements, and also receive bills, acts and other documents. Permission to the processing of personal data is valid for the entire duration of the Agreement, as well as for an unlimited period after its expiration. In addition, by concluding this Agreement, the Customer confirms that he has been notified (without additional notice) of the rights established by the Law of Ukraine "On the Protection of Personal Data", the purpose of data collection, and that his personal data are transferred to the Seller for the purpose of fulfillment of the terms of this Agreement, the possibility of mutual settlements, as well as to receive bills, acts and other documents. The Customer also agrees that the Seller has the right to provide access and transfer its personal data to third parties without any additional notification of the Customer, without changing the purpose of processing personal data. The scope of the rights of the Customer, as a subject of personal data in accordance with the Law of Ukraine "On the protection of personal data", is known and understandable to him.

2. TERMS AND DEFINITIONS

Visitor - a person who came to the site / without the purpose of making an Order.

User - an individual, a visitor to the Site who accepts the terms of this Agreement and wants to place Orders on the site.

Buyer - the User who performed the Order on the site.

The seller is self-employed person Lev Polina Sergeevna, which acts on the basis of the State Registration Statement 3571409000 dated October 6, 2017, established in accordance with the Law of Ukraine, leading the management of the website located on the Internet at https://en.supersus.shop/ .

Online store - an Internet site belonging to the Seller, located on the Internet at the address /, where the Goods offered by the Seller for purchase, as well as the terms of payment and delivery of the Goods to the Buyers are presented.

Site - https://en.supersus.shop/.

Product - a list of goods published on the website of the online store, for which the price, name and description of the goods are indicated. Also, the product may be accompanied by its image.

Order - a properly executed request of the Buyer for the purchase and delivery to the address specified by the Buyer, selected on the Site.

3. SUBJECT OF CONTRACT

3.1. The subject of this Agreement is to provide the User with the opportunity to purchase for personal, family, home and other needs not related to business activities, the Goods presented in the catalog of the online store at https://en.supersus.shop/.

3.2. This Agreement applies to all types of goods and services presented on the Site, as long as such offers with a description are present in the catalog of the online store.

4. REGISTRATION ON THE SITE

4.1. Registration on the Site is carried out at https://en.supersus.shop/.

4.2. Registration on the Site is not mandatory for ordering.

4.3. The Seller is not responsible for the accuracy and correctness of the information provided by the User during registration.

4.4. The User undertakes not to disclose to third parties the login and password specified by the User during registration. In case of any suspicion of the User regarding the security of his login and password or the possibility of their unauthorized use by third parties, the User undertakes to immediately notify the Seller by sending an appropriate e-mail to the address pohs.susrepus%40pohs

4.5. Communication of the User / Buyer with the representatives of the Seller should be based on the principles of generally accepted morality and communication etiquette. It is strictly forbidden to use obscene words, abuse, abusive language, as well as threats and blackmail, regardless of the form and to whom they were addressed.

5. GOODS AND PROCEDURE FOR BUYING

5.1. The seller ensures the availability in his warehouse of the Products presented on the Site. Accompanying photos of the Product may differ slightly from the actual appearance of the Goods, taking into account the peculiarities of the color transfer of the various devices with which the Site is viewed. Accompanying product descriptions / specifications do not claim to be exhaustive information and may contain typos. Updating information provided on the Site, is done every 5 minutes.

5.2. In the absence of the Goods ordered by the Buyer in the Seller's warehouse, the latter has the right to exclude the specified Goods from the Order / cancel the Buyer's Order, notifying the Buyer by sending an appropriate e-mail to the address specified by the Buyer during registration, or by other means.

5.3. In case of cancellation of a fully or partially prepaid Order, the value of the canceled Goods is returned by the Seller to the Buyer in the manner in which the Goods were paid.

5.4. The Buyer bears full responsibility for providing incorrect information, which entailed the impossibility of the Seller to properly fulfill his obligations to the Buyer.

5.5. After placing the Order on the Site, the Buyer is provided with information on the expected date of delivery by sending an e-mail to the address indicated by the Buyer upon registration, or by phone. The manager serving this Order specifies the details of the Order, coordinates the delivery date, which depends on the availability of the ordered Goods at the Seller's warehouse and the time required for processing and delivery of the Order.

5.6. The expected date of transfer of the Order to the Delivery Service shall be communicated to the Buyer by the manager serving the Order, by e-mail or during a test call to the Buyer.

6. PRICE AND PAYMENT ORDER

6.1. The price of each individual Goods is determined by the Seller and indicated on the website of the online store. The price of the Order is determined by adding the price of all the Products included in the Order and the price of delivery, which is equal to the amount payable, which is indicated on the website of the online store when placing the Order at the time of its placement.

6.2. The contract price is equal to the order price. The order amount may vary depending on the price, quantity or product range.

6.3. The buyer makes the payment of the goods according to the order. The buyer chooses one with such payment methods:

- cashless payments.

6.4. Payment for Services is carried out in the national currency of Ukraine.

6.5. The order is considered to be paid from the moment of receipt of payment to the account of the Seller or his representative. The fact of payment of the Order indicates the consent of the Buyer with the terms of this contract.

6.6. The price of the Goods, which is indicated on the website of the online store, may be changed unilaterally by the Seller. At the same time, the price for the Goods ordered by the Buyer is not subject to change.

6.7. Until the Buyer's funds are credited to the Seller's account, the goods are not reserved. The Seller cannot guarantee the availability of the Goods of the Seller in the quantity specified at the time of placing the Order, as a result of which the terms for processing the Order may increase.If it is necessary to return the funds by the Seller to the Buyer, in order to return the funds, the Buyer is obliged to inform the Seller of the bank account details to which the Seller is obliged to transfer the funds.

7. RETURN OF GOODS AND MONEY

7.1. The return of the goods is carried out in accordance with the "Terms of return" indicated on the Site at https://en.supersus.shop/vozvrat/

7.2. Return goods of good quality:

7.2.1. The Buyer has the right to refuse the ordered Goods at any time prior to its receipt, and after receiving the Goods - within 14 days, not counting the day of purchase, except for the Goods specified in clause 7.2.4. present agreement. The return of the Goods of good quality is possible if their presentation, consumer properties, as well as the availability of a document confirming the fact and conditions for the purchase of the specified Goods are preserved.

7.2.2. If the Buyer refuses the Goods in accordance with clause 7.2.1. The Seller returns the value of the returned Goods to him, excluding the Seller's expenses related to the delivery of the Goods returned by the Buyer, within 10 days from the date of receipt of the returned Goods to the Seller's warehouse together with the return request filled by the Buyer.

7.2.3. If, at the time of the Buyer's request, a similar product is not available from the Seller, the Buyer has the right to refuse to perform this Agreement and to demand a refund of the amount paid for the specified Goods. The seller must return the amount of money paid for the returned goods within 3 days from the date of return of the Goods.

7.3. Return the goods of inadequate quality:

7.3.1. Under the goods of inadequate quality means a product that has an obvious defect of production nature. The received goods must comply with the description on the Site. The difference of design elements or design from the description stated on the Site is not a sign of inadequate quality.

7.3.2. The appearance of the Goods, as well as the completeness of the entire Order must be checked by the Recipient at the time of delivery of the Goods.

7.3.3. Upon delivery of the goods, the buyer puts his signature on the delivery receipt. After receiving the Order, claims to external defects of the goods, their quantity, completeness and presentation are not accepted.

7.3.4. Requirements for the return of the amount of money paid for the goods are subject to satisfaction within 14 days from the date of the presentation of the relevant requirement (Law of Ukraine No. 1023-XII "On Protection of User Rights", 12.05.1991).

7.4. Refunds are made by returning the cost of the paid Goods to a bank card or in cash.

8. RESPONSIBILITY

The Seller is not responsible for the Buyer's selection of the Goods, he only guarantees the conformity of the ordered positions.

9. PRIVACY AND PROTECTION OF INFORMATION

9.1. When registering on the Site, the User provides the following information: name, phone number, email address, password to access the Site.

9.2. By providing their personal data to the Seller, the Site Visitor / User / Buyer agrees to the Seller's processing, including for the purpose of promoting the goods and services by the Seller, as well as transferring personal data to third parties attracted by the Buyer to fulfill obligations to the Site Visitor / User / Buyer within the scope of this Public Offer.

9.4. The Seller uses the personal data of the User / Buyer:

for registration of the User on the Website;

to fulfill its obligations to the User / Buyer;

for evaluation and analysis of the Site;

to determine the winner in promotions held by the Seller.

9.4.1. The Seller has the right to send information, including advertising messages, to the email and mobile phone of the User / Buyer with his consent. The User / Buyer has the right to refuse to receive advertising and other information without explaining the reasons for refusal. Service messages informing the User / Buyer about the order and the stages of its processing are sent automatically and cannot be rejected by the User / Buyer.

9.5. The seller has the right to use the technology "cookies". "Cookies" do not contain confidential information and are not transmitted to third parties.

9.6. The seller receives information about the ip-address of the Site Visitor. This information is not used to identify the visitor.

9.7. The Seller is not responsible for the information provided by the User / Buyer on the Site in a generally accessible form.

10. ADDITIONAL CONDITIONS

10.1. The online store and the services provided may be temporarily partially or completely unavailable due to preventive or other work or for any other technical reasons. The Seller's Technical Service has the right to periodically carry out the necessary preventive or other works with or without prior notice to the Buyers.

10.2. The relations between the User / Buyer and the Seller are subject to the provisions of the Ukrainian legislation.

10.3. The parties shall make maximum efforts to eliminate the arising differences only through negotiations. If an agreement is not reached, the dispute will be submitted to the judicial authority in accordance with the current legislation of Ukraine.

10.4. In case of force majeure, documented by relevant authorities, the parties are exempt from the execution of this contract.

10.5. The recognition by the court of the invalidity of any provision of this Agreement does not entail the invalidity of the remaining provisions.
